In a Chapter 7 bankruptcy proceeding, you have the opportunity to discharge certain debts in exchange for the sale or liquidation of non-exempt assets. If you qualify for protection under Chapter 7, I will make certain that you understand which obligations, such as child support arrearages, student loan payments and certain taxes, cannot be discharged. I will also confirm that all exempt assets, including your primary residence and vehicle, are excluded from sale in the bankruptcy proceeding.

To qualify for protection under Chapter 7, you must submit to a means test, which determines whether you have the financial resources to repay your creditors over a 3 to 5 year period. I know how this process works and will walk you through the test before you file, so that you have confidence that your Chapter 7 petition will be granted.
